Judge Elden Fox ordered the actress to appear. She is currently at the Betty Ford Center for her addiction to cocaine. Lindsay tested positive for cocaine during one of her random drug tests that were a condition of her probation. Judge Fox previously said that any dirty drug test would result in 30 days in jail for the Mean Girls star.
Sources close to the situation tell us that Lohan won’t dispute the test results, turning the court action into a sentencing hearing instead of a more formal probation violation hearing. (Lindsay admitted that she slipped up via Twitter after initially denying it, when the first news reports of her “dirty” test appeared.)
“Lindsay will be sentenced next Friday for her probation violation,” a close source told RadarOnline.com exclusively. “Judge Fox could do several things. He could order her to jail immediately, sentence her to 30 days and suspend the sentence until she completes her stint at Betty Ford Center. Or he could come up with another scenario. “Lindsay’s fate rests with Judge Fox.”
Lindsay will be escorted from Betty Ford by at least one staff member from the facility. “Lindsay will have someone with her at all times when she leaves Betty Ford,” said a source. “They want to make sure that Lindsay is not tempted by anything.”

Desperate for a soda fix, Lohan and a companion reportedly attempted to sneak over the rehabilitation clinic’s fence to use the vending machine at the neighboring Eisenhower Medical Center.
The shifty plan was hindered when Lohan’s counterpart hitched her clothing on a fence, forcing the trapped actress to surrender to a Betty Ford volunteer passing by in a golf cart.
After being chauffeured back to the caffeine-free treatment center, Lohan and her partner in crime interrupted a process meeting that was organized to discuss their actions.
Lohan will have to try and remain decaffeinated until her court date on Oct. 22.
Hollyscoop: Lindsay Lohan is reportedly getting treatment at a rehab facility in Orange County. The name of the center has not been disclosed, but sources tell RadarOnline.com that’s where she currently is.
A source from the rehab said, “She is with us for the time being. We expect her to stay for the full 90 days, however she could bounce because there is no court order ensuring that she has to stay.”
Another rehab source says they hope this time makes a difference. “Hopefully we will be able to make a difference,” the source said. “If she makes it through the first couple weeks, she should be ok.”
Michael Lohan told Hollyscoop what he wants for this daughter. “If Lindsay stays in for a long period of time and she gets family therapy with Dina and I, then she has a shot,” said Michael. “Lindsay and I went to therapy together when she was at Cirque Lodge and Dina went with Lindsay. But against the wishes of the doctors, therapist and lawyers, Dina refuses to go with Lindsay and me.”
He went on to bash his ex-wife saying, “According to one highly regarded therapist, Dina is a narcissist…she cannot admit any of wrongs. She can not take responsibility. And she always will find a way to blame others for the things she does.”
“Lindsay was a very strong young lady,” Michael says of his daughter. “But the people around her have made her feel that she is week and dependent on them. She always had Dina and me, but since Dina put walls between us she feels alone. She always needs someone with her. Her heart is huge. She is gifted and if things are done as they should be, she will rebound better than ever.
“It’s all on Dina to get this right, but I her that her new found friendship with Lou Taylor will only hurt Lindsay. They need to stop trying to control her and my relationship with her.”

Actress Lindsay Lohan is set to be released from jail after Judge Patricia M. Schnegg from The Los Angeles Superior Court set a $300,000 bail for jail release just hours past a Beverly Hills judge sentenced Lohan to spend 30 days in jail on Friday (September 24) after she failed a drug test, The Los Angeles Times reports.
It’s speculated that Schnegg had set the bail to release Lohan from jail due to the overcrowding of the California county’s women’s jail in Lynwood.
Judge Elden Fox had sentenced Lindsay to go back to jail without bail until October 22 when another hearing on her case would be held. Lindsay’s attorney, Shawn Chapman Holley, released an statement considering Fox’s decision as legally incorrect because it involved probation violation for a misdemeanor conviction: “The case law is clear, She is entitled to bail.”, said Chapman Holley. The case was then passed to Judge Patricia Schnegg that ruled that Lindsay deserved bail.
Lindsay Lohan was back to The Los Angeles Superior Court on Friday (September 24) to face the consequences for her failed drug test last week.
The actress was told by Judge Elden Fox to report to jail immediately, she was reportedly handcuffed during the hearing. According to TMZ, Lohan could be behind bars up to October 22, when the next hearing is scheduled to be happening.
Lindsay showed up to court wearing sunglasses, a long black blazer over a high-waisted white skirt and black top and shiny stacked heels at 8 A.M. (PT), five days after Judge Fox revoked her probation and issued a bench warrant.
TMZ has learned that Lindsay failed two drug tests, one for cocaine (which she admitted) and other for amphetamines, the later related to a medicine she takes and the judge wouldn’t sentence jail time for it.
According to her post-rehab agreement, Lindsay could be sent back to jail for 30 days. Lindsay’s first jail time was 13 days long (she was sentenced 90 days).
RadarOnline.com has confirmed that her case with E-Trade has been dismissed, according to her attorney Stephanie Ovadia.
“Yes, it’s true, we’ve settled with E-Trade,” Ovadia told RadarOnline.com exclusively.
Ovadia wouldn’t reveal specifics of the case, but we’re told her team is very happy with the results.
Lohan claimed the stock trading company violated her rights by featuring a baby character named Lindsay during their television commercial ads, who happens to be the “milkaholic” other woman in a baby love triangle.
“E-Trade has always maintained that the claims were without merit, which is why we moved to dismiss the case,” a spokesperson for the company told RadarOnline.com.
“With the case now withdrawn, we are pleased to have the matter behind us.”
One less legal battle has come as a relief to the Mean Girls star as well.
As RadarOnline.com reported, Lindsay failed two court mandated drug tests – testing positive for cocaine in one test and amphetamines in the other.
An arrest warrant has just been issued for the actress and her probation revoked.
After initially denying the failed drug tests, Lohan eventually admitted to it on her Twitter page saying, “I’m prepared to face the consequences.”

Lohan has been ordered to appear in court at 8:30 a.m. Friday, according to TMZ, and the warrant will be held until then, the site says.
News broke Friday that Lohan had allegedly failed two random drug tests ordered as part of her probation; later that day, the actress posted a mea culpa on Twitter, saying in part, “If I am asked, I am prepared to appear before judge Fox next week as a result.”

The New York Daily News reports that Lindsay Lohan has failed a court-mandatory test on drug using, as it resulted positively for cocaine usage.
A source reveal that Lohan failed the test sometime last week. The terms of her probation call her back to jail for 30 days for failing the test.
Sources close to Lindsay Lohan told TMZ about her situation: “People with addiction problems don’t get better magically, and she’s really been making an effort to make herself better.”
No court date to discuss the failed test has been set and the Prosecutors of her case have not released any statement.
A spokesperson for Lindsay Lohan released a note to FOX News few hours after the news surfed the web stating that Lindsay did not fail the test and that the rumors are not true. This news has yet, to be confirmed.
New York Post: Former jailbird Lindsay Lohan is in talks to appear on the final season of “The Oprah Winfrey Show,” celebrity website RadarOnline reported Thursday.
Although the deal has yet to be finalized, the talks between the troubled “Mean Girls” actress and the U.S. talk show queen’s team were “looking very good,” the website reported, citing a source.
“Things are heating up in a good way. Definitely some good conversations. We’re crossing our fingers it works out for Oprah’s last season,” the source said.
Another source close to Lohan told the gossip site, “Several entities are being considered, and no decision has been made and won’t be for a while.”
Since serving 14 days in jail and 22 days in rehab for violating her probation on a DUI charge, Lohan has remained somewhat quiet, although an interview she did with Vanity Fair prior to her incarceration was published on Aug. 31.
In that interview Lohan insisted she was not an alcoholic, but admitted to “dabbling in certain things and trying things” because she was “young and curious.” She added that since her release she was focused on “learning how to continue to get through the trauma that my father has caused in my life.”
The final season of Winfrey’s long-running talk show will begin in the U.S. on Sept. 13. Her last episode will air Sept. 9, 2011.
Lindsay Lohan may face more legal trouble… Two eyewitnesses allege to have spotted the actress leaving an apartment building in West Hollywood, California in her Maserati and then running a red-light, making a left and running straight to a stroll being pushed by a nanny.
“It was full impact, a major hit”, photographer Brian Jaime tells TMZ.com, adding that the nanny was hit in the legs and the stroller also had an impact.
The photographer, got on tape, the baby crying and the nanny trying to push the stroller further and sold it to RadarOnline.com, on the video, a vehicle (which is said to be Lohan’s) is seen leaving the scene.
The West Hollywood Sheriff’s department said no report has been filled: “No claim has been made with the West Hollywood Sheriff’s station, so if it did in fact happen, and I don’t know if it did or not, but if it did, no one called to report it to us.”
CBS News: After spending two weeks in jail and 30 days in rehab, it’s possible that Lindsay Lohan may be released early from the UCLA Medical Center where she is currently serving a court-ordered 90-day sentence for violating her probation.
According to E! News, Judge Fox is ready to give her ruling in favor or against Lohan’s early dismissal from rehab, a day before the scheduled hearing.
Although there is a lot of speculation surrounding Lohan’s early release, there has reportedly been some progress during her prison and rehab stints.
After evaluating Lohan, doctors concluded she does not suffer from ADHD or bipolar disorder, and perhaps the improperly prescribed Adderall contributed to her problematic behavior, reports E! News.
Unfortunately, Lohan and her legal camp will have to keep their fingers crossed until tomorrow to hear the official verdict.
New York Daily News: Troubled starlet Lindsay Lohan is out of jail and into rehab.
The “Mean Girls” actress was released from the Century Regional Detention Facility at 1:35 a.m. Monday, spirited out a back exit as dozens of photographers and reporters waited in a press staging area out front.
She served 14 days of a 90-day sentence, getting out early because of jail overcrowding.
“She was picked up by court order by a designated driver,” sheriff’s spokesman Steve Whitmore told the Daily News, declining to confirm rumors that mom Dina Lohan picked up her daughter. “We had to comply with the wishes of the court, and safety and security were the paramount concerns. It wasn’t special treatment.”
Whitmore told the assembled press less than 10 minutes after Lohan was secretly sprung that “she has been sent directly to her next destination, which is a treatment center, and she will now be under the supervision of the LA County Probation Department.”
Two black Cadillac Escalades were spotted speeding past the Lynwood jail minutes after deputies strung yellow caution tape near the door that Paris Hilton used for her famous exit in 2007.
Some photographers groused that the tape barriers were erected as a ruse.
Lohan began her jail term with the expectation she’d have a 24-hour break before reporting to 90 days of inpatient rehab. But Judge Marsha Revel changed her ruling late last week and ordered Lohan to start treatment immediately after her release from jail, a source told The News.
In another last-minute move, Revel changed Lohan’s rehab center to one in west Los Angeles over fears outsiders might be able to slip banned substances to the actress.
She was previously slated to attend Morningside Recovery in Orange County, multiple outlets reported.
“We were not involved in the decision. We were informed after the judge made the change,” district attorney spokeswoman Jane Robison told The News, confirming the switch.
According to TMZ.com, Revel originally chose Morningside to treat the 24-year-old Lohan for bipolar disorder as well as addiction to methamphetamines and opiates.
Lohan’s lawyer denied the report.
“I have never seen any psych report which references ‘bipolar’ or ‘meth,’” said attorney Shawn Chapman Holley.
An earlier probation report said Lohan had been taking the amphetamine-based prescription drug Adderall – which is used to treat attention deficit hyperactivity disorder – for “as long as she can remember.”
It listed her other prescriptions as the antidepressants Zoloft and trazadone and the powerful opiate Dilaudid for dental pain.
Lohan landed in jail July 20 after Revel said she violated probation in her 2007 DUI case.
The judge mentioned the cocaine involved of both of Lohan’s DUI busts when she levied the punishment for missing mandatory alcohol education classes.
ABC News: Lindsay Lohan, Who Could Be Released Sunday, Reportedly Has Stylists on Call
Lindsay Lohan reportedly has her team of stylists at the ready in preparation for a possible Sunday release from jail.
Several of Lohan’s favorite stylists and hair and makeup people have been put on call from midnight today through the entire weekend, according to Popeater’s Rob Shuter.
That would suggest that Lohan is expecting to depart from the Century Regional Detention Facility in Lynwood, Calif., by this weekend after two weeks into her 90-day sentence.
Steve Whitmore, a spokesman for the Los Angeles Sheriff’s Department, told the Los Angeles Times this week that Lohan’s earliest release date would likely be Sunday. And the release would most likely happen at midnight to minimize the expected media circus.
The 30-second walk from the detention center exit to an awaiting car is likely to be beamed around the world. And chances are Lohan will want to look her best.
She doesn’t need to do much, her lawyer, Shawn Chapman Holley, said.
“She looks gorgeous,” Holley told reporters Wednesday after visiting the jailed starlet. “She’s writing a lot. She’s creating art.
“She’s a beautiful, talented, creative woman, and she’s going to come out and surprise you all.”
Lucky for Lohan she got to keep her hair extensions, unlike other inmates who are required to remove them once they enter jail.
Detention center authorities told the Los Angeles Times that the extensions were sewn near her scalp, making it difficult for staff to remove them.
Lohan is already preparing for what’s next after leaving jail. Holley said she was upset about the prospect of having to go straight to rehab.
“Right now, the issue is how much time she’ll have when she’s released before she has to do the second part of her sentence, which is rehab,” Holley told reporters. “She’d obviously like to spend some time with her family. … She wants me to emphasize that to judge Revel.”
While Lohan’s time in jail has not been a cakewalk — there were reports that she had a hysterical breakdown and was driving fellow inmates crazy with special requests — Holley has insisted that her client is playing the part of the perfect prisoner.
“She is doing fine,” attorney Holley told UsMagazine.com last Sunday. “She has made some friends.
“We are not asking for special treatment from the court or the sheriff, nor is she receiving special treatment,” Holley added.
While she will reportedly tell all about her time in jail in a major TV sitdown after her release, Lohan’s mindset can be gleaned from a photo of her upper left arm taken the day she was carted from a Beverly Hills court to jail: What appears to be a bruise is actually the base for a tattoo of a little girl with her eyes closed.
People Magazine: As far as reports go, Lindsay Lohan is eating the same meals as regular inmates at the Century Regional Detention Facility. But that doesn’t mean she’s being entirely treated like the others.
“She’s not treated like if it was anyone else going to jail,” Maria Medina, a relative of an inmate at Lohan’s jail tells PEOPLE. “Like, if they even want to bring her new clothes or bring her anything, they put the whole facility on lockdown. It happens all the time.”
Medina, 40, says residents at the jail, based in Lynwood, Calif., find it unfair that someone they’re not even allowed to see is exerting so much control over their stay.
“All the inmates are sick of Lindsay,” Medina says. “It’s almost like Lindsay Lohan’s here, but she’s not. Like if she even moves, they put the whole facility on lockdown. It happens all the time. For example, just yesterday [Friday], Lindsay had to go to the mini-clinic, and the whole place was on lockdown again.”
Los Angeles Sheriff’s spokesman Steve Whitmore denied Medina’s claim. “It’s business as usual. Lindsay’s getting no special treatment,” he told PEOPLE on Saturday. He also said there is no such thing as “lockdowns.”
As far as Lohan is concerned, she’s now apparently in a much better state of mind than earlier this week.
“[Lindsay's] doing well, she’s doing fine,” Lohan’s lawyer Shawn Chapman Holley tells PEOPLE. “Her outlook is definitely more positive.”
Despite speculation that Lohan was given exemptions when it came to visitation limits, Holley told reporters her client is playing by the rules, saying,”[Her family's] not allowed any more visits this week.”
Whitmore earlier this week told PEOPLE that Lohan received her visits during the week to avoid disrupting other families visiting on the weekend with ensuing TV crews and photographers.
